Upon receipt of a valid DMCA notice, Snewswire.com will act expeditiously to remove or disable access to the allegedly infringing content. We will also take reasonable steps to promptly notify the user or contributor who posted the material that we have removed or disabled access to it.
Counter-Notification Procedure
If you believe that the material you posted was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us. To be effective, a counter-notification must be a written communication sent to our Designated Agent that includes the following:
- Identification of the material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access was disabled.
- A statement under penalty of perjury: A statement that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material.
- Your contact information: Your name, address, telephone number, and email address.
- Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside of the United States, for any judicial district in which Snewswire.com may be found), and that you will accept service of process from the person who provided the original copyright infringement notification or an agent of such person.
- Your signature: Your physical or electronic signature.
Upon receipt of a valid counter-notification, we will forward a copy to the original complaining party. The original complaining party will then have ten (10) business days to notify us that they have filed an action seeking a court order to restrain you from engaging in the infringing activity. If we do not receive such notification within ten (10) business days, we may restore the material to our website.
Repeat Infringers Policy
In accordance with the DMCA and other applicable law, Snewswire.com has adopted a policy of terminating, in appropriate circumstances, users or contributors who are deemed to be repeat infringers. We may also at our sole discretion limit access to the website and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
